Mediation is a process to facilitate a resolution of a dispute. A third party will act as mediator in between the disputed parties. The meditation process may be informal and non-adversarial that will help the disputing parties to reach amicable settlement. The ultimate decision-making rests with the parties but on the mediator. In fact the mediators convince the parties about disadvantages if the dispute is not settled or continued. The mediator provides various alternatives so that parties can choose the best alternative. Yet, the mediator no authority to force settlement on the parties. The parties can terminate mediation process at any point of time. Similarly, the mediator also can terminate the mediation in case if the mediator feels that either party unwilling to mediate. The agreement reached by the parties out of the mediation constitutes binding agreement when it is signed by their attorneys.
